Protected technology includes the ontological architecture and our own implementation of the parameter computation, signal fusion, authenticity scoring, on-device and edge processing, and dual-use deployment. Open-source components (MediaPipe, face-api.js) and published signal-processing methods stay under their own licences and are not claimed as ours.

EmoPulse does not use a proprietary training dataset. The camera front end runs on open-source components (MediaPipe, face-api.js) under their own licences, and physiological signals come from published signal-processing methods.

The Software constitutes confidential information and trade secrets. Access does not imply, create, or grant any license, right, or interest except as stated in the Limited Viewing License below.

Data Protection

Unauthorized access to biometric or personal data through the Software may violate:

EU General Data Protection Regulation (GDPR), Regulation (EU) 2016/679 - fines up to €20,000,000 or 4% of annual global turnover
Other applicable data protection and biometric privacy laws

Enforcement & Penalties

European Union

Civil action under Directive 2001/29/EC. Patent infringement claims upon grant. Enforcement under Directive 2004/48/EC. Damages including actual loss, lost profits, and moral damages. GDPR enforcement. Criminal prosecution under applicable EU member-state law.

United States

Copyright infringement under 17 U.S.C. § 501. Statutory damages up to $150,000 per willful infringement. Trade secret misappropriation under the Defend Trade Secrets Act (DTSA). Attorney fees recovery.

The Owner actively monitors for unauthorized use, including automated scanning of public repositories and code-similarity analysis.

Governing Law & Jurisdiction

EU Disputes

Governed by the laws of the European Union and its member states. Exclusive jurisdiction of the competent courts of the European Union.

US Disputes

Governed by the applicable federal laws of the United States. Exclusive jurisdiction of the competent federal courts of the United States.
