Enforcement & Penalties
European Union
Civil action under Directive 2001/29/EC. Patent infringement claims upon grant. Enforcement under Directive 2004/48/EC. Damages including actual loss, lost profits, and moral damages. GDPR enforcement. Criminal prosecution under applicable EU member-state law.
United States
Copyright infringement under 17 U.S.C. § 501. Statutory damages up to $150,000 per willful infringement. Trade secret misappropriation under the Defend Trade Secrets Act (DTSA). Attorney fees recovery.
The Owner actively monitors for unauthorized use, including automated scanning of public repositories and code-similarity analysis.
Governing Law & Jurisdiction
EU Disputes
Governed by the laws of the European Union and its member states. Exclusive jurisdiction of the competent courts of the European Union.
US Disputes
Governed by the applicable federal laws of the United States. Exclusive jurisdiction of the competent federal courts of the United States.
